Measures for the Administration of Participation in International Standardization Activities of the International Organization for Standardization (ISO) and the International Electrotechnical Commission (IEC)

CHAPTER I GENERAL PROVISIONS

Article 1: In order to strengthen the management of China's participation in international standardization activities, improve China's ability and level of participation in international standardization activities, and in accordance with the Standardization Law of the People's Republic of China, the Implementation Regulations of the Standardization Law of the People's Republic of China, and relevant regulations on foreign affairs management of the country, these Measures are formulated.

Article 2: Participation in international standardization activities referred to in these Measures refers to participation in relevant activities of the International Organization for Standardization (ISO) and the International Electrotechnical Commission (IEC). Specifically, it includes:

(1) Serving as an official or member of the central management bodies of ISO and IEC;

(2) Serving as the head of ISO and IEC technical organizations;

(3) Undertake the work of the ISO and IEC technical organization secretariat;

(4) Serve as the convener of the working group or registered expert;

(5) Undertake the work of domestic technical counterpart units of ISO and IEC technical institutions, and participate in the activities of technical institutions as an active member or observer;

(6) Propose new international standard work projects and new technology work areas, and oversee the revision of international standards;

(7) Participate in the revision of international standards, track and study international standard documents, and conduct voting and evaluation;

(8) Participate in or host international conferences of ISO and IEC;

(9) Other international standardization activities participated in.

Chapter 2 Job Responsibilities

Article 3: The standardization authority of the State Council shall organize and manage all aspects of China's participation in international standardization activities, and represent China in ISO and IEC organizations, fulfilling the following responsibilities:

(1) Develop and organize the implementation of policies, plans, and schedules for China's participation in international standardization work;

(2) Undertake the ISO China National Member Body and IEC China National Committee Secretariat, responsible for the daily work of the ISO China National Member Body and IEC China National Committee, as well as liaison with the ISO and IEC Central Secretariat;

(3) Coordinate and guide relevant domestic industries and localities to participate in international standardization activities;

(4) Guide and supervise the work of domestic technology counterpart units, establish, adjust, and abolish domestic technology counterpart units, review and establish domestic technology counterpart working groups, review and register Chinese experts to participate in international standard revision working groups;

(5) Review and submit proposals for new international standard work projects and new technology work areas, determine and apply for China's membership in ISO and IEC technical organizations, and guide and supervise the voting process for international standard documents;

(6) Review and adjust the members, responsible persons, and secretariat units of ISO and IEC management and technical organizations in China, and manage their daily work;

(7) Apply and organize technical conferences for ISO and IEC hosted by our country, and manage our delegation's participation in ISO and IEC technical conferences;

(8) Organize and carry out international standardization training and publicity work;

(9) Other responsibilities related to participating in international standardization activities management.

Article 4: The relevant administrative departments of the State Council, industry associations with industry management functions, and group companies (hereinafter referred to as "industry competent departments") shall be entrusted by the standardization competent department of the State Council to manage their respective departments and industries' participation in ISO and IEC international standardization activities, and perform the following responsibilities:

(1) Propose institutional recommendations for domestic technology counterpart units to support their participation in international standardization activities;

(2) Guide domestic technology counterpart units to track and study international standardization activities, as well as vote and evaluate international standard documents;

(3) Guide and review proposals for new international standard work projects and new technology work areas;

(4) Organize the department and industry to carry out international standardization training and publicity work;

(5) Report to the standardization authority of the State Council before January 15th each year on the participation of the industry in international standardization activities in the previous year;

(6) Other responsibilities related to the management of international standardization activities in this industry.

Article 5: The standardization administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government shall be entrusted by the standardization administrative department of the State Council to assist in the management of relevant parties participating in international standardization activities within their respective administrative regions, and shall perform the following duties:

(1) According to the guidelines, policies, and work arrangements for China's participation in international standardization activities, promote and support relevant parties within the administrative region to participate in international standardization activities;

(2) Organize tracking, research, and analysis of international standardization activities closely related to the economic and trade development of the administrative region;

(3) Based on the advantages and characteristics of this administrative region, organize proposals for new international standard work projects and new technology work areas;

(4) Propose institutional recommendations for domestic technology counterpart units, and contact and support domestic technology counterpart units within this administrative region;

(5) Regularly report to the standardization authority of the State Council on the participation of the administrative region in international standardization activities.

Article 6: Domestic technology counterpart units shall specifically undertake the domestic technology counterpart work of ISO and IEC technical institutions, and fulfill the following responsibilities:

(1) Strictly follow the relevant policies and regulations of ISO and IEC to carry out work, responsible for organizing, planning, coordinating, and managing participation in international standardization activities in the corresponding fields, tracking, researching, and analyzing the development trends and work dynamics of international standardization in the corresponding fields;

(2) According to the needs of international standardization activities in this field, responsible for establishing a domestic technology matching working group, which will undertake various tasks related to participating in international standardization activities in this field. The members of the domestic technology matching working group should include relevant production enterprises, inspection and certification institutions, universities, consumer groups, industry associations, and other relevant parties. The professional field represented should cover all fields involved in the ISO and IEC technology scope of the matching field;

(3) Strictly abide by the relevant provisions of the intellectual property policy of the International Organization for Standardization, timely distribute international standards, draft international standards and document materials of ISO and IEC, and regularly issue relevant document catalogs, establish and manage work files related to international standardization activities such as international standards, draft international standard documents, registered expert information, and international standard conference documents;

(4) Based on the needs of domestic work, conduct necessary experiments and verifications on the technical content of international standards, coordinate and propose voting and evaluation opinions on international standard documents;

(5) Organize proposals and suggestions for new international standard technology work areas and new international standard work projects;

(6) Organize a Chinese delegation to participate in international conferences organized by relevant ISO and IEC technical organizations;

(7) Propose the application for hosting ISO and IEC technical organization meetings in China, and be responsible for the preparation and organization of the meetings;

(8) Propose membership (active member or observer) in ISO and IEC technical organizations;

(9) Propose to participate in the ISO and IEC international standard setting working group registration expert recommendations;

(10) Timely report work to the standardization department of the State Council, the industry department, and the local standardization administrative department, and submit the previous year's work report and the "Report on Domestic Technology Matching Work in Participating in ISO and IEC International Standardization Activities" (Attachment 2) before January 15th each year;

(11) Maintain contact with relevant national professional standardization technical committees and other domestic technical counterparts;

(12) Participate in international standardization activities related to other technical fields.

Chapter 3 Management of Domestic Technology Matching Units

Article 7: Principles for Establishing Domestic Technology Matching Units:

(1) The establishment of domestic technology counterpart units should correspond to ISO and IEC technical institutions. Domestic technology counterpart units of ISO and IEC technical committees do not automatically become domestic technology counterpart units of their sub technical committees;

(2) In principle, the domestic technical counterpart units shall be undertaken by the Secretariat of the National Professional Standardization Technical Committee corresponding to the professional field. If there is no corresponding National Professional Standardization Technical Committee, it shall be undertaken by enterprises, research institutes, inspection and testing certification institutions, industry associations, and higher education institutions with strong technical strength and the ability to organize and participate in international standardization work in the professional field.

Article 8: Domestic technology counterpart units shall meet the following conditions:

(1) Legal person organizations established within the territory of our country in accordance with the law;

(2) Has strong technical strength and influence, and has strong organizational and coordination abilities to participate in international standardization activities;

(3) There are staff who are familiar with international standardization procedures and have a good level of English proficiency;

(4) Having specialized institutions and the necessary funds and office conditions for carrying out work;

(5) Other conditions stipulated by the standardization authority of the State Council.

Article 9: Domestic technology counterpart units shall include participation in international standardization activities in their work plans and daily work.

Article 10: The establishment procedures for domestic technology counterpart units include application, qualification review, approval, and establishment, which specifically include:

(1) Industry regulatory departments, standardization administrative departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, as well as the Secretariat of the National Professional Standardization Technical Committee, undertaking units, enterprises, research institutes, inspection and testing certification institutions, industry associations, and higher education institutions can all apply to the standardization regulatory department of the State Council to undertake domestic technology counterpart units and submit the "Application Form for Undertaking Domestic Technology counterpart Units" (Attachment 3);

(2) The standardization authority of the State Council is responsible for conducting qualification review on applications submitted to undertake domestic technology counterpart units;

(3) For applications that meet the requirements and are coordinated, the standardization department of the State Council shall provide written approval. For applications that cannot be coordinated but are urgently needed for social and economic development and participation in international standardization activities, the standardization department of the State Council shall organize inspections and demonstrations, make decisions based on the results of the demonstrations, and approve them;

(4) Domestic technology counterpart units should initiate relevant work within 10 working days after being approved by the standardization authority of the State Council.

Article 11: The standardization authority of the State Council shall regularly inspect the work of domestic technology counterpart units. If any of the following situations occur, the responsible unit may be adjusted:

(1) Failure to fulfill the responsibilities of domestic technical counterpart units, failure to carry out work normally or ineffective work, and serious quality problems in international standardization work;

(2) Those who fail to fulfill their obligation to vote according to international standards and have a voter turnout below 90%;

(3) Not attending international conferences twice in a row and not explaining the reasons to the standardization department of the State Council;

(4) Using the work of domestic technology counterpart units to seek illegitimate benefits for the unit or related stakeholders;

(5) Violating the use of international standardization work funds and failing to correct it within the prescribed time limit;

(6) There are other behaviors that should be adjusted.

Article 12: If domestic technology counterpart units no longer undertake corresponding work, they shall submit an application 6 months in advance and make adjustments after being reviewed by the standardization department of the State Council.

Article 13: If the corresponding ISO and IEC technical institutions are revoked or their scope of work is adjusted, and the undertaking unit is no longer suitable to serve as a domestic technical counterpart, the standardization authority of the State Council may revoke or adjust them.

Article 14: If the domestic technical counterpart units of ISO and IEC technical committees and their sub technical committees are undertaken by different units, they shall be responsible for the international standard voting and other work in the corresponding fields. The domestic technical counterpart units of the sub technical committee should regularly report their work situation to the domestic technical counterpart units of the technical committee.

Article 15: Domestic technology counterpart units shall strengthen communication with each other:

(1) If the domestic technical counterpart units of ISO and IEC technical committees are not the same as those of their sub technical committees, a liaison relationship should be established;

(2) If there is a liaison relationship between ISO and IEC technical organizations, corresponding domestic technical counterparts should also establish a liaison relationship;

(3) Domestic technology counterpart units may appoint observers to participate in the work of the technology counterpart working group that establishes contact relationships, obtain relevant international standard documents, participate in meeting discussions, but do not have voting rights;

(4) The domestic technology counterpart units and the corresponding National Professional Standardization Technical Committee's secretariat are not the same unit, and should establish a liaison relationship with the corresponding National Professional Standardization Technical Committee to jointly study and analyze international standards, and form China's voting opinions on international standard drafts. When adopting international standards, domestic technical counterpart units should provide the corresponding national professional standardization technical committee with international standard drafts and documents, as well as technical consultation.

Chapter 4 Work Procedures and Requirements

Section 1: Responsible Person and Secretariat

Article 16: Industry regulatory authorities, standardization administrative authorities of provinces, autonomous regions, and municipalities directly under the Central Government, as well as the Secretariat of the National Professional Standardization Technical Committee, undertaking units, enterprises, research institutes, inspection and testing certification institutions, industry associations, and higher education institutions may apply to the standardization regulatory authorities of the State Council to assume the responsibilities of ISO and IEC technical institutions and the Secretariat. The standardization authority of the State Council conducts qualification review on the applicants and units, and uniformly applies to ISO and IEC.

Article 17: The person in charge of ISO and IEC technical organizations shall meet the following requirements:

(1) Ensure the fulfillment of the duties of Chairman, Vice Chairman, and Secretary as stipulated by ISO and IEC regulations;

(2) Familiar with professional knowledge and international standardization procedures in the corresponding ISO and IEC technical fields, proficient in using ISO and IEC information technology tools;

(3) To serve as the chairman or vice chairman, one should have the ability to preside over international conferences and coordinate international perspectives in English, French, or Russian;

(4) To serve as a secretary, one should have the ability to record the convening of international conferences, handle daily work documents of the secretariat, and communicate internationally in English, French, or Russian.

Article 18: Units responsible for ISO and IEC technical organization heads and secretaries shall meet the following requirements:

(1) Having a fixed office location and necessary office equipment, able to carry out the daily work of the Secretariat in accordance with ISO and IEC requirements;

(2) Provide necessary financial support for our unit to undertake the work of ISO and IEC technical organization leaders;

(3) Submit a work report to the standardization authority of the State Council before January 15th each year, fill out the "Report on China's International Standardization Work Undertaking ISO and IEC Technical Institutions" (Attachment 4), and copy the industry or local standardization authority.

Section 2 Determination of Membership Status

Article 19: There are two identities for participating in ISO and IEC technical activities: active members and observers. Those who can ensure the fulfillment of active member obligations in areas that are closely related to national economic and social development, attend international conferences in accordance with ISO and IEC work requirements (including participation through communication), and promptly handle matters related to voting on international standard drafts should apply to become active members. Those who do not meet the above conditions can apply to be observers. Encourage domestic technology counterparts to actively participate in international standardization work as members.

Article 20: The membership of technical organizations participating in ISO and IEC shall be proposed by domestic technical counterparts and reported to the standardization authority of the State Council, which shall uniformly apply to ISO and IEC.

Article 21: The standardization authority of the State Council may adjust the membership status of domestic technical counterpart units in ISO and IEC technical organizations based on work conditions.

Section 3 Voting

Article 22: Domestic technology counterpart units shall solicit opinions from all relevant domestic parties within the prescribed time, and submit voting and evaluation opinions on international standard documents. If there is an industry regulatory department, the voting and evaluation opinions should be copied to the industry regulatory department at the same time. The industry regulatory authorities should organize and coordinate the different opinions of various stakeholders, and submit voting and comments to the standardization regulatory authorities of the State Council within the prescribed time.

Article 23: Domestic technology counterpart units may directly log in to the ISO international standard voting system for external voting when processing international standard documents within the ISO committee, with authorization and permission from the standardization authority of the State Council.

Article 24: Domestic technology counterpart units shall log in to the International Standard Voting System of the Standardization Administration of the State Council for voting on international standard documents such as ISO draft, final draft, and review. After the standardization authority of the State Council approves the voting and comments of domestic technology counterparts, it will conduct a unified external voting.

Article 25: Domestic technology counterpart units shall log in to the international standard voting system of the standardization authority of the State Council for voting when processing IEC international standard documents. After the standardization authority of the State Council approves the voting and comments of domestic technology counterparts, it will conduct a unified external voting.

Article 26: Domestic technology counterpart units shall use the comment form uniformly stipulated by ISO and IEC when handling international standard voting. When submitting the comment to the standardization authority of the State Council, both Chinese and English shall be provided.

Section 4: Submitting Proposals

Article 27: The standardization authority of the State Council encourages all relevant parties to actively propose new international standard work projects and new technology work areas to ISO and IEC. Any institution in China, such as enterprises, research institutes, inspection and testing certification agencies, industry associations, and universities, may submit proposals.

Article 28: The submission of proposals for new international standard work projects shall follow the following procedures:

(1) According to the requirements of ISO and IEC, prepare the International Standard New Work Project Proposal Application Form, as well as the Chinese and English drafts or outlines of the International Standard, and fill out the "International Standard New Work Project Proposal Review Form" (Attachment 5) issued by the standardization authority of the State Council;

(2) The above materials have been coordinated and reviewed by relevant domestic technical counterparts, and after being reviewed by industry regulatory authorities, they will be submitted by the domestic technical counterparts to the standardization department of the State Council; After review by the standardization authority of the State Council, the application shall be submitted to the relevant technical institutions of ISO and IEC in a unified manner; If there is no industry regulatory department, domestic technology counterpart units can directly submit applications to the standardization regulatory department of the State Council;

(3) The proposing unit and relevant domestic technical counterparts should closely track the status of proposal approval, actively promote the process of international standard revision, and promptly report relevant information and supporting documents to the standardization authority of the State Council for filing.

Article 29: The submission of proposals for new technology work areas shall follow the following work procedures:

(1) According to the requirements of ISO and IEC, prepare an application form for proposing new work areas for international standards, and fill out the "Application Form for New Technology Work Areas of the International Organization for Standardization" (Attachment 6) issued by the standardization authority of the State Council;

(2) In principle, the proposal materials shall be submitted to the relevant industry or local competent department for review. After approval by the industry or local competent department, the proposer shall submit them to the standardization competent department of the State Council; After review by the standardization authority of the State Council, the application shall be submitted to the relevant ISO and IEC organizations in a unified manner.

Section 5: Participating in the Working Group

Article 30: For ISO and IEC technical organizations in which China actively participates as members, domestic technical counterparts should actively select experts from various relevant fields to participate in the working group and strive to serve as the convener of the working group. At IEC technical institutions, domestic technical counterparts should select experts to participate in at least one working group.

Article 31: Experts who intend to participate in the working group shall first apply to the domestic technical counterpart unit. Domestic technology counterpart units are responsible for conducting qualification reviews of experts, submitting the "ISO/IEC Working Group Expert Application Form" (Attachment 7) to the standardization authority of the State Council, and copying it to the relevant industry regulatory authorities. After being reviewed by the standardization authority of the State Council, unified external registration will be conducted; If experts are nominated during the voting phase of a new work project, domestic technical counterparts should register the expert information with the standardization department of the State Council after the project is officially approved.

Article 32: Experts of the working group shall actively participate in the activities of the working group, fulfill their duties as experts, maintain close contact with the convener of the working group, participate in the working group meetings directly or through communication, and make positive contributions to the drafting of relevant international standards. If there is a change in the personal contact information of an expert, it should be promptly reported to the convener of the working group and copied to the standardization department of the State Council and domestic technical counterpart units.

Article 33: Technical opinions from experts participating in work group activities shall be submitted to domestic technical counterparts for review; Those who attend the working group meeting should submit a participation report to the domestic technical counterpart unit within 30 days after the meeting ends.

Section 6: Participation in Technical Institution Meetings

Article 34: Domestic technology counterpart units are responsible for organizing and preparing contingency plans for the Chinese delegation to attend ISO and IEC technical organization meetings.

Article 35: Domestic technology counterpart units shall forward the meeting notice to the domestic technology counterpart working group and relevant units within 5 working days after receiving the ISO and IEC meeting notice. Domestic relevant units participating in international conferences should apply to domestic technology counterparts and participate in the Chinese delegation organized by the domestic technology counterparts. They are not allowed to contact ISO and IEC on their own.

Article 36: Domestic technology counterpart units are responsible for conducting qualification reviews of representatives participating in international conferences, filling out the "Registration Form for Participating in ISO and IEC Conferences" (Attachment 8), and proposing suggestions for the composition and leader of the Chinese delegation. In principle, the team leader should have the technical and language skills to make statements and speeches. The proposal for the attending group should be submitted to the standardization authority of the State Council and copied to the relevant industry authorities. The standardization authority of the State Council shall submit the application for participation to ISO and IEC and register the attending representatives.

Article 37: Representatives attending international conferences shall comply with the following work requirements:

(1) Strictly abide by foreign affairs discipline;

(2) Strictly carry out attendance tasks, attend international conferences on time, and avoid absenteeism;

(3) Carefully prepare the attendance plan, and all delegation members should follow the unified guidelines of the attendance plan to carry out international communication and exchange work during the attendance period, and make speeches at the meeting;

(4) When attending a conference, only the leader of the delegation has the right to vote and express their opinions on the conference resolution. With the authorization of the leader, other representatives can speak or express their opinions at the conference.

Article 38: Without the review of the standardization authority under the State Council, no unit or individual shall represent China at ISO and IEC conferences, and the sending unit shall be fully responsible for any consequences arising therefrom.

Article 39: The foreign affairs procedures for representatives attending ISO and IEC conferences shall be handled by the representative's sending unit in accordance with relevant national foreign affairs management regulations.

Article 40 Domestic technology counterpart units shall submit a written summary to the standardization authority of the State Council within 30 days after the end of the meeting, and copy the industry authority. 

Section 7: Hosting ISO and IEC Technical Organization Meetings

Article 41: Domestic technology counterpart units shall first consult with the relevant technical organizations of ISO and IEC, and submit an application to the standardization authority of the State Council. After reviewing the relevant requirements for holding international conferences in China, the standardization authority of the State Council shall submit a formal application to ISO and IEC for hosting the conference.

Article 42: The standardization department of the State Council shall serve as the host unit of the conference, and domestic technical counterpart units or other units entrusted by them shall serve as the organizer of the conference.

Article 43: The organizing unit of the conference shall comply with the relevant regulations for holding international conferences in China, and shall not charge registration fees for conference representatives.

Article 44: The organizing unit of the conference shall submit a summary of the conference to the standardization department of the State Council within 30 days after the end of the conference, and copy it to the industry regulatory department.

Chapter 5: Funds and Rewards and Punishments

Article 45: The funds for participating in international standardization activities by domestic technology counterpart units, ISO and IEC technical institution heads, and secretariat units shall be included in the budget of their own units and local governments.

Article 46: The standardization authority of the State Council shall provide subsidies for important international standardization activities such as serving as the head of ISO and IEC technical organizations, undertaking the secretariat, and leading the development of international standards.

Article 47: Subsidies for international standardization activities shall be disbursed in accordance with relevant regulations of the Ministry of Finance, included in the unified management of unit finances, separately accounted for, and used exclusively for designated purposes. No unit or individual shall withhold or misappropriate them, and shall accept supervision and inspection by the standardization competent department of the State Council and audit by audit institutions. Those who intercept or misappropriate funds shall be dealt with in accordance with relevant regulations.

Article 48: The standardization authority of the State Council shall commend domestic technology counterpart units and individuals who have made outstanding achievements in participating in international standardization activities, mainly including the following situations:

(1) Obtaining ISO or IEC awards;

(2) Proposing international standards and leading the development of international standards with outstanding performance;

(3) Diligently fulfilling the job responsibilities of ISO and IEC technical organization leaders and demonstrating outstanding performance;

(4) Seriously fulfilling the responsibilities of the secretariat of international technical institutions and domestic technical counterparts, actively carrying out international standardization work and demonstrating outstanding performance;

(5) Actively organizing industry and local participation in international standardization activities and making outstanding contributions;

(6) Those who have made outstanding contributions to the training of international standardization talents and the research of international standardization policies;

(7) Other situations that require rewards.

Article 49: If domestic technology counterpart units, heads of ISO and IEC technical institutions undertaken by China, and their undertaking units violate these Measures and fall under any of the following circumstances, the standardization authority of the State Council shall order them to rectify within a specified period of time:

(1) Not expressing opinions on international standard drafts in accordance with regulations for two consecutive times, and participating in and hosting international conferences; Not fulfilling the responsibilities of domestic technology counterpart units seriously and failing to organize relevant domestic institutions to participate in international standardization activities in the field of ISO and IEC technology counterpart.

(2) Failure to conscientiously fulfill the responsibilities of ISO and IEC technical organization heads and secretaries, inability to effectively organize and carry out international standardization activities in this technical field, and being notified by ISO and IEC.

(3) Not using and managing work funds in accordance with regulations.

(4) There are other illegal and irregular behaviors.

Chapter 6 Supplementary Provisions

Article 50: Experts from the Hong Kong Special Administrative Region, Macao Special Administrative Region, and Taiwan region shall participate in international standardization conferences in accordance with the requirements of the International Organization for Standardization and China.

Article 51: Participation in ISO and IEC qualification assessment activities shall be managed by the National Certification and Accreditation Administration, and specific management measures shall be formulated separately.

Article 52: These Measures are mainly formulated in accordance with the requirements of participating in international standardization activities, such as ISO and IEC charters and technical work procedures. The management of participating in other international and regional standardization organization activities can refer to these Measures for implementation or formulate corresponding management regulations.

Article 53: These Measures shall come into effect on May 1, 2015. The Management Measures for Participating in Technical Activities of the International Organization for Standardization (ISO) and the International Electrotechnical Commission (IEC) issued by the former State Administration for Technical Supervision (No. 372, 1992) are hereby abolished.
